The Statute of Limitations in Tennessee

The statute of limitations in Tennessee is one of the shortest across the U.S., being only one year. This means that you have one year from the date of your injury to file a personal injury claim. There are three main exceptions to this. The first being if an injury victim is under the age of 18 or has been determined "adjudicated incompetent" by the court. Adjudicated Incompetent means mentally incompetent at the time. In these cases, the individual has one year from their 18th birthday or from their date of restored competence to file a claim.

The second exception is if the negligent party resides or is absent for a prolong period from the state of Tennessee. Their date of absence will most likely not be counted in the one year time frame. The last exception is if the negligent party has criminal charges brought against them. In this case they statute of limitations would extent to two years.
