Filing for Divorce in Tennessee

According to Tennessee Code Ann. § 36-4-104 (a), you must live in Tennessee for a minimum of 6 months before you are able to legally file for a divorce within the state. Or, if you or your spouse are in the military and stationed in Tennessee, you may file for divorce in Tennessee so long as you have lived in Tennessee for a year (even if you are permanent residents of another state).

There is also a mandatory waiting period for divorce filed in Tennessee. By law, there is a 60-day waiting period for divorcing spouses without children under the age of 18, and a mandatory 90-day waiting period for spouses with children under the age of 18 years old. In most cases, the court will also order couples to participate in mediation before the divorce can be pushed forward through the court.

Property Division in West Tennessee

In Tennessee, the division of marital property follows an equitable division rule. In other words, the property shared between spouses is divided in a way that is equitable, but not necessarily equal.

In order to determine how property will be divided, the court will first differentiate between marital property (what the couple shared and what is divisible) and separate property (what each spouse owns individually and is not subject to division).

How is Alimony Awarded in a Divorce?

The court will consider alimony much differently than property division. With alimony, the court may consider “fault” in the way alimony is awarded, especially in cases where one spouse may have harmed or negatively impacted the other, by financial means or otherwise. However, alimony decisions are not black and white and are very dependent on each unique case.

There are four types of alimony awarded in Tennessee, including:

  1. Lump-Sum Alimony: This type of alimony may be granted in addition to more traditional alimony payments, or in lieu of regular alimony, in order to provide the receiving partner with support.
  2. Periodic Alimony: Periodic alimony may be awarded in addition to rehabilitative alimony if a spouse is only partially rehabilitated, or in lieu of rehabilitative alimony if rehabilitation is considered infeasible.
  3. Transitional Alimony: In the event that the court decides rehabilitative alimony is unnecessary, but the disadvantaged spouse still requires financial support as they adjust to their new means after a divorce or separation, they may be awarded transitional alimony for a brief period of time.
  4. Rehabilitative Alimony: Courts will award rehabilitative alimony to support the disadvantaged spouse to permit them a standard of living comparable to the state enjoyed during the marriage or similar to the standard the other spouse will experience after the divorce.
